Pursuant to MBMC Section 14.24.055, every property owner, prior to the sale or transfer of any real property upon which is located any structure connected to the City's water supply shall retrofit the structure with water saving devices, the flow rates of which comply with the requirements of the most recent version of the California Plumbing Code.

The present requirements for Water-Conserving Fixtures and Fittings, prescribed in Section 402 of the 2007 California Plumbing Code are as follows:

The owner or their agent shall contact Public Services at (805) 772-6261 prior to close of escrow and inquire whether a Certificate of Compliance has already been issued for that property.  If a Certificate of Compliance has not yet been issued, then the owner or their agent may request an inspection to verify compliance. The fee for the inspection will be as prescribed in the Master Fee Schedule.  Any property not in conformance shall be retrofitted prior to issuance of the Certificate of Compliance. Persons may be eligible for a rebate under the Water Conservation Rebate Program.
